Prelaunch terms

This is a translation. If there is any discrepancy, the Spanish version prevails.

These terms govern your registration and your account in the WinParking prelaunch. By signing up you confirm that you have read and accept them.

1. Who we are

WinParking is a project of Fermín Solano Delgado (Tax ID 72805505V), with business address at Calle Padre Barace, 1 Bj (trs), 31007 Pamplona (Navarre), Spain, and email legal@winparking.com. More details in the legal notice.

2. What the prelaunch is

WinParking will be a platform for renting garage parking spaces between individuals and businesses, on the web and in apps for Android and iPhone. While we prepare it, the prelaunch lets you:

create your account and save your place before we open;
get your referral link for the affiliate programme;
answer a survey to help us decide where and how to launch;
be notified when we open in your country.

During the prelaunch you cannot list spaces, book or pay. Signing up is free. We do not guarantee an opening date or that we will open in any particular country: we will open each country when we decide to, starting with Spain, and until then only this prelaunch is available there.

3. Who can sign up

To sign up you must:

be 18 or over and have legal capacity to enter into contracts;
live in a European Union country, the United Kingdom, Switzerland, Norway or Andorra;
provide true data and keep it up to date;
verify your email. Your account becomes active as soon as you verify it;
have only one account. Giving your phone number is optional during the prelaunch and required to activate your account when we open; each phone number can only be linked to one account.

4. Your account

You sign in with a link we send to your email, without a password. Keep your email account secure: anyone who accesses it will be able to enter your WinParking account. If you suspect misuse, use "Sign out on all devices" and write to legal@winparking.com.

5. Communications

We will send you the necessary service emails: sign-up confirmation, account notices, updates on your affiliate programme, the notice that we are opening in your country and changes to these terms. The news and offers newsletter will only reach you if you have accepted it in its own box, and you can unsubscribe with one click.

6. Rules of use

You may not:

create fake or automated accounts, or accounts in another person's name;
use phone numbers that are not yours or bulk SMS-receiving services;
try to get around verification, limits or the website's protections;
use the website for unlawful purposes, send spam or harm WinParking or other users;
break the affiliate programme rules.

7. Suspension and closure

You can delete your account at any time from your dashboard. If it is suspended while we review possible fraud, write to us and we will delete it when the case is closed, as explained in the privacy policy. We may suspend or close your account if you break these terms, notifying you first and explaining why, except in serious cases (fraud, impersonation or attacks), where we may act immediately. If we decide to end the prelaunch without launching the service, we will give you at least 15 days' notice and delete the data as described in the privacy policy.

8. When we launch

When WinParking opens, your prelaunch account will become your user account. To list spaces or book you will have to accept the general terms of the service, which we will publish then. If you do not accept them, you can delete your account.

8a. Founder badge

If, before WinParking opens in the country you gave when signing up, you verify your email and phone and complete the survey, you'll get the "Founder" badge on your profile and, once we open, on your space listings. It's a recognition with no monetary value. You only lose it if you delete your account or we suspend it for fraud, always after review by a person.

9. Transfer to the company

The WinParking activity is expected to be transferred to Win Parking, S.L. (a single-member limited company based in Pamplona), to be incorporated in early 2027. By signing up you agree that these terms, your account and your participation in the affiliate programme may be transferred to that company on the same terms. We will email you before doing so.

10. Intellectual and industrial property

The WinParking trademark, its logos, designs, texts and code belong to their owner. Signing up gives you no rights over them, except the use of the trademark allowed by the affiliate programme terms.

11. Liability

The prelaunch is a phase before the service and is provided as it is. We will do our best to keep it working, but we are not liable for interruptions, errors or loss of information, unless caused by our wilful misconduct or gross negligence. Nothing in these terms limits your statutory rights as a consumer.

12. Changes to these terms

If we change these terms, we will notify you by email and on the website at least 15 days before they apply, and ask you to accept the new version next time you sign in. If you disagree, you can delete your account. We keep a record of which version you accepted and when.

13. Governing law and complaints

These terms are governed by Spanish law. If you are a consumer, you may go to the courts of your place of residence. For any complaint, please write to legal@winparking.com first.
